But to do that we have to make a connecting flight to Philadelphia from Charlotte, NC will we get stopped? theres no direct flight back to England from Charlotte, so this is our only option.... will we be okay? vivac, thats not what i asked.

Overstaying the Visa waiver guarantees he won't be able to use it again, not to mention it will be very difficult to have even a visitor's visa approved when he leaves. Likelihood of returning to the US less than 2% imo.

I don't know if this helps you or not, but US Airways DOES have a direct flight from Charlotte to London Gatwick. Good luck!

Leaving the country will be no problem. But,he will probably be denied for a return.Since the INS became the jurisdiction of the Department of Justice, laws are enforced, due to 9/11,which i can not blame them for.

going out is not the problem ... you will have no problem there... Coming back is a different story Is there no way he can stay and file for AOS

The flight from Charlotte to Philadelphia is a domestic flight so it is unlikely that any CBP officers would be at the departure gate. In Philadelphia, there is a slim chance that CBP officers may be at the departure gate, but the outstanding directions at this time are not to prevent the departure of an illegal alien, like your husband, if they are about to board a plane to depart the U.S. If a CBP Officer stops and questions your husband, he will not prevent your husband's departure (unless there is a warrant out for his arrest). He might question him, fingerprint him, photocopy his documents, search his belongings, but he isn't going to stop him from leaving.
